Terms of Service

I. Introduction

These Terms of Service ("Terms") govern the use of the AngelImperatrix website, services and products provided by the Provider.
AngelImperatrix is an independent creative and software development initiative engaged in the development and publication of video games, software applications, literary works and other digital and creative products, as well as the provision of online services and educational resources.
These Terms establish the general rules applicable to the use of AngelImperatrix Accounts, the AngelImperatrix website and the services and functionality made available through such Accounts. An Account may also be used to access or authenticate with AngelImperatrix Products that support Account functionality.
An Account is not required for every Service or Product. Certain features, including the submission of solutions to algorithmic problems, the retention of programming tutorial progress, online multiplayer functionality and other features requiring persistent User data or authentication, may require an Account.
Individual Products or Services may be subject to additional Product-Specific Terms, rules, licence agreements or other conditions. Such terms are intended to supplement these Terms and apply to the relevant Product or Service. If a User identifies any apparent inconsistency between these Terms and any Product-Specific Terms, the User should report the matter to the Provider and await clarification or correction before relying upon the inconsistent provision.
These Terms do not grant access to every AngelImperatrix Product or Service merely by virtue of holding an Account. Access to individual Products and Services may be subject to additional requirements, including applicable age guidance, Product-Specific Terms, technical requirements, availability and any other conditions applicable to the relevant Product or Service.
Where a Product or Service is subject to terms or conditions imposed by a third party, including a distribution platform, marketplace, network service or other third-party provider, the User remains responsible for complying with those terms and conditions in addition to these Terms.
The Provider may make changes to the Services, Products and functionality made available through AngelImperatrix from time to time. Such changes may include the introduction, modification, suspension or discontinuation of individual features, Products or Services, subject to these Terms and Applicable Law.
By creating an Account where acceptance of these Terms is required, or by accessing or using a Service or Product to which these Terms apply, the User acknowledges that the User has read and understood these Terms and agrees to be bound by them.
If the User does not agree to these Terms, the User must not create an Account where acceptance is required and must not access or use the relevant Services or Products.

II. Definitions

For the purposes of these Terms:
“Provider” means AngelImperatrix, as the provider of the Services and Products to which these Terms apply.
“AngelImperatrix” means the creative, software development and publishing initiative operating under the AngelImperatrix name and, where applicable, the Products and Services provided under that name.
“Terms” means these Terms of Service and any provisions or documents expressly incorporated into them by reference.
“User” means any individual who accesses or uses the Website, a Service or a Product subject to these Terms.
“Account” means an AngelImperatrix user account created for a User for the purpose of accessing or using Services or Products that require or support Account functionality.
“Account Holder” means the User to whom an Account is registered.
“Website” means the official AngelImperatrix website or websites through which the Services are made available.
“Service” or “Services” means any online service, functionality, feature or platform made available by the Provider under the AngelImperatrix name, including account functionality, the algorithmic problem-solving platform, programming tutorials and related online functionality.
“Product” or “Products” means any game, software application, literary work or other digital or creative product developed, published, distributed or otherwise made available by the Provider under the AngelImperatrix name.
“Product-Specific Terms” means any additional terms, rules, licence agreements or other conditions applicable to a particular Product or Service, which supplement these Terms.
“User Content” means any content, material, data, text, code, image, audio, video, post, comment, submission or other material submitted, uploaded, transmitted or otherwise made available by a User through a Service.
“Public User Content” means User Content made available by a User to other Users or to the public through a Service, including posts, comments and other publicly visible contributions.
“Submission” means a solution, program, source code or other material submitted by a User to an Algorithmic Problem for evaluation or validation through a Service.
“Algorithmic Problem” means an algorithmic, programming, computational or similar problem made available through a Service for the purpose of solving, submitting and evaluating solutions.
“Programming Tutorial” or “Programming Tutorials” means programming tutorials and other educational or instructional resources made available through a Service, including any associated interactive functionality.
“Progress Data” means data associated with a User’s use of a Service or Product for the purpose of recording or maintaining progress, results, scores, achievements, completion status or other activity.
“Third-Party Service” or “Third-Party Services” means any service, infrastructure, platform, distribution channel, marketplace, network, internet access service, hardware or other facility operated or provided by a third party and used by a User in connection with a Service or Product.
“Parent or Guardian” means a person having parental responsibility, guardianship or equivalent legal authority over a User who is a minor, as recognised under Applicable Law.
“Applicable Law” means any law, regulation, statutory requirement or other legally binding rule applicable to the Provider, the User, the relevant Service or Product, or the relevant use or transaction, as applicable.

III. Acceptance of these Terms

By creating an Account where acceptance of these Terms is required, the User confirms that the User has read, understood and agrees to be bound by these Terms.
Where an Account is created on behalf of a minor by a Parent or Guardian, the person creating the Account confirms that they have the legal authority to do so and that the Account is being created for the intended User.
Acceptance of these Terms is required before an Account may be created where such acceptance is required by the relevant Service or Product.
Where these Terms apply to a Service or Product that does not require an Account, the User accepts these Terms by accessing or using that Service or Product.
Certain Services and Products may also be subject to Product-Specific Terms or other applicable rules. Where acceptance of such terms is required, the User must accept them before accessing or using the relevant Service or Product.
If the User does not agree to these Terms, the User must not create an Account where acceptance is required and must not access or use any Service or Product to which these Terms apply.
The User is responsible for ensuring that the information provided during Account registration is accurate and that the User has the legal capacity or, where applicable, the necessary parental or guardianship authority to accept these Terms.
Acceptance of these Terms does not grant the User any ownership rights in the Website, Services, Products or other intellectual property of the Provider.

IV. Eligibility

Eligibility to access or use a particular Service or Product may depend on the age requirements applicable to that Service or Product.
Certain Products or Services may be intended for Users of a specified minimum age. Any age rating or age indication provided by the Provider is intended to assist Users and Parents or Guardians in determining the suitability of the relevant Product or Service.
Unless a different minimum age is required by Applicable Law, an age rating or age indication does not, by itself, constitute a contractual prohibition on access by a User who is below the indicated age. The Provider recommends that Users respect the indicated age rating and that Parents or Guardians exercise appropriate judgement when determining which Products and Services are suitable for a minor.
Where Applicable Law establishes a minimum age for access to or use of a Service or Product, that legal requirement applies regardless of any age rating or age indication provided by the Provider.
The Provider does not ordinarily perform identity or age verification as a condition of creating an Account. The User is responsible for providing accurate information regarding their age where such information is requested and for ensuring that their use of the relevant Services and Products complies with Applicable Law.
The Provider recommends that Users under 16 years of age have their Account created or managed by a Parent or Guardian, particularly where the Account is used to access online multiplayer functionality, public communication features or other interactive online Services. This is a recommendation and is not, unless otherwise required by Applicable Law or the Product-Specific Terms of a particular Product or Service, a condition of eligibility.
A Product or Service may impose additional eligibility requirements through its Product-Specific Terms. Such requirements apply in addition to this section.
The Provider may restrict access to a Service or Product where access is prohibited or restricted by Applicable Law, or where such restriction is necessary to comply with a legal obligation.

V. Accounts and Account Security

An Account may be required to access or use certain Services or Products, including Services that require persistent User data, authentication or synchronisation between sessions or Products.
Each Account must be registered to a valid email address. An email address may be associated with only one Account at a time.
A User may hold more than one Account. Where a User holds multiple Accounts, the User must not represent those Accounts as belonging to different individuals where they are, in fact, controlled or used by the same User.
An Account is personal to the Account Holder and must not be sold, transferred, assigned, lent, shared or otherwise made available for use by another person.
The Account Holder is responsible for maintaining the confidentiality of their Account credentials and for taking reasonable measures to prevent unauthorised access to the Account.
The User must not knowingly permit another person to access or use the User's Account, except where such access is expressly permitted by the Provider or is otherwise provided for under these Terms or the applicable Product-Specific Terms.
The User must promptly notify the Provider if the User becomes aware of unauthorised access to, or other material compromise of, the Account.
The Provider may take reasonable measures to protect Accounts and the Services, including requiring security measures, restricting access, temporarily suspending an Account or requiring the User to take steps to secure the Account.
The Provider does not guarantee that an Account will be immune from unauthorised access, compromise or other security incidents.
The User is responsible for activity carried out through the User's Account, except to the extent that such responsibility cannot reasonably be attributed to the User or is otherwise limited by Applicable Law.
An Account must not be created or used for the purpose of circumventing a suspension, termination or other restriction imposed by the Provider under these Terms or applicable Product-Specific Terms.
Where an Account is deleted by the Account Holder, the email address associated with that Account may subsequently be used to register another Account, subject to these Terms.
Where an Account is terminated by the Provider as a result of a violation of these Terms or applicable Product-Specific Terms, the email address associated with that Account may be prevented from being used to register another Account.
The Provider may require information reasonably necessary to establish, maintain, secure or recover an Account, subject to the Provider's applicable Privacy Policy and Applicable Law.

VI. Services and Products

The Provider may make available a variety of Services and Products under the AngelImperatrix name, including video games, software applications, literary works, educational resources and other digital or creative products.
The Services may include online functionality associated with AngelImperatrix Accounts, including algorithmic problem-solving, Programming Tutorials, online multiplayer functionality, User Content features and other services made available from time to time.
Not every Service or Product requires an Account. Where an Account is required, the relevant Service or Product may use the Account to provide authentication, synchronisation, persistent User data, access control or other Account-related functionality.
An Account does not constitute a licence or entitlement to access every Service or Product made available by the Provider. Access to a particular Service or Product may be subject to additional requirements, including Product-Specific Terms, technical requirements, age guidance, availability, purchase or licence requirements, or requirements imposed by a Third-Party Service.
The Provider may introduce new Services or Products and may modify existing Services or Products from time to time. A modification may include changes to functionality, content, technical requirements, supported platforms, availability or other characteristics of a Service or Product.
The Provider may discontinue a Service or Product where reasonably necessary or appropriate, subject to Applicable Law and any rights or obligations that cannot lawfully be excluded or terminated.
The Provider does not guarantee that any particular Service or Product will remain available indefinitely or that a Service or Product will remain compatible with any particular hardware, operating system, software, network, platform or Third-Party Service.
Certain Products may be distributed or made available through Third-Party Services. The availability, functionality, purchase, installation or continued support of such Products may depend upon the relevant Third-Party Service and its terms and requirements.
Where a Product is made available under a separate licence or Product-Specific Terms, the User's rights to use that Product are subject to those terms in addition to these Terms.
Nothing in these Terms obliges the Provider to develop, release, maintain or continue any particular Service, Product, feature or functionality unless expressly stated otherwise or required by Applicable Law.

VII. Availability of the Services and Products

The Services and Products are provided on an "as is" and "as available" basis, subject to Applicable Law.
The Provider does not guarantee that any Service or Product will be continuously available, uninterrupted, error-free, secure or free from defects.
The Provider may temporarily suspend or restrict access to a Service or Product where necessary for maintenance, updates, security measures, technical work, investigation of incidents or other operational reasons.
Temporary interruptions may also occur due to circumstances beyond the Provider's reasonable control, including failures or interruptions affecting Third-Party Services, internet access, telecommunications networks, hosting infrastructure, hardware, power supply or other external infrastructure.
The Provider may modify, update, replace or remove features or functionality of a Service or Product where reasonably necessary or appropriate. Such changes may temporarily or permanently affect the availability or operation of the relevant Service or Product.
The Provider does not guarantee that any Service or Product will be compatible with every device, operating system, software version, network configuration, hardware configuration or Third-Party Service.
The Provider may impose reasonable technical limitations on the use of Services or Products, including limitations relating to storage, processing, network traffic, submissions, requests, multiplayer functionality or other resources, where necessary for the security, stability or proper operation of the relevant Service or Product.
Where a Product is distributed through a Third-Party Service, the Provider does not control the availability, operation or continued support of that Third-Party Service. Problems affecting the Third-Party Service may therefore affect the availability or functionality of the relevant Product.
The Provider does not guarantee that errors, defects or interruptions affecting a Service or Product will be corrected within any particular period of time or that every issue can or will be resolved.
Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded or limited under Applicable Law.

VIII. Permitted Use

The User may access and use the Services and Products only for their intended purposes and in accordance with these Terms, the applicable Product-Specific Terms and Applicable Law.
The User may use the Services and Products only through the features, interfaces, access methods and functionality made available or authorised by the Provider or, where applicable, by the relevant Third-Party Service.
The User may access and use a Service or Product only to the extent that the User has been granted the necessary access or licence to do so.
The User may use an Account to access Services and Products that support Account functionality in accordance with these Terms and the applicable Product-Specific Terms.
Where a Service permits the User to submit Solutions, create User Content, participate in discussions, use online multiplayer functionality or otherwise interact with other Users, the User may do so provided that such activity complies with these Terms, the applicable Product-Specific Terms and any rules or limitations communicated by the Provider for the relevant Service or Product.
The User may retain and use their own Submissions, including previously submitted Solutions, where such functionality is provided by the relevant Service.
The User may access and use publicly available User Content through the relevant Service for its intended purpose, subject to these Terms and any restrictions imposed by the User who made such content available or by the Provider.
Nothing in these Terms grants the User ownership of, or any other rights in, the Services, Products, Website, Provider Content or other intellectual property belonging to the Provider, except for the limited rights expressly granted under these Terms or the applicable Product-Specific Terms.
The User must not use a Service or Product in a manner that exceeds the scope of the access, licence or permissions granted to the User.
Where Applicable Law grants the User rights that cannot be excluded or restricted by these Terms, those rights remain unaffected.

IX. Prohibited Conduct

The User must not use, access or interact with any Service or Product in a manner that violates these Terms, the applicable Product-Specific Terms or Applicable Law.
The User must not:

  • use any Service or Product for any unlawful, fraudulent, malicious or abusive purpose;
  • interfere with, disrupt, damage, overload or otherwise adversely affect the normal operation, security or availability of any Service, Product, Website or related infrastructure;
  • intentionally introduce malware, malicious code or other harmful software, data or material into any Service, Product or system;
  • attempt to gain unauthorised access to any Account, Service, Product, system, network, server, database or other infrastructure associated with AngelImperatrix;
  • attempt to bypass, disable, circumvent or otherwise interfere with authentication, access controls, security measures, technical restrictions or other mechanisms intended to restrict or regulate access to a Service or Product;
  • conduct, assist with, encourage or facilitate denial-of-service attacks, distributed denial-of-service attacks or similar attacks against AngelImperatrix, its Services, Products, infrastructure, Users or Third-Party Services;
  • engage in doxxing, the malicious disclosure of another person's private or identifying information, or other conduct intended to expose another person to harassment, harm or unwanted contact;
  • impersonate the Provider, AngelImperatrix, any member of the AngelImperatrix staff, any Administrator or another User, or otherwise falsely represent an affiliation with or authority to act on behalf of any such person or entity;
  • use a Service or Product to harass, threaten, intimidate, abuse or deliberately cause harm to another User, the Provider or any other person;
  • use automated systems, scripts, bots or other means to access or interact with a Service or Product in a manner that is not expressly authorised by the Provider;
  • scrape, extract, systematically collect or reproduce data or content from a Service or Product except where expressly permitted by the Provider or by Applicable Law;
  • exploit bugs, vulnerabilities, unintended behaviour or other technical weaknesses in a Service or Product for personal advantage, to gain unauthorised access, to disrupt the Service or Product, or to cause harm to the Provider or another User;
  • cheat, manipulate results, falsify progress, circumvent evaluation mechanisms or otherwise obtain an unfair advantage in any game, competition, multiplayer Service, Algorithmic Problem or other activity where such conduct is contrary to the intended operation of the relevant Service or Product;
  • share, publish, distribute or otherwise provide another person with a Submission for the purpose of circumventing the intended evaluation, learning or individual-solving nature of an Algorithmic Problem or related Service;
  • modify, tamper with, decompile, disassemble, reverse engineer or otherwise attempt to derive the source code or underlying structure of a Product or Service, except to the extent that such conduct cannot lawfully be restricted under Applicable Law;
  • copy, reproduce, distribute, publicly communicate, publish, transmit or otherwise make available any Product, Provider Content or other material belonging to the Provider except where expressly authorised by the Provider or permitted by Applicable Law;
  • remove, alter or obscure copyright notices, trade marks, attribution notices or other proprietary notices contained in a Product, Service or other Provider Content;
  • publish, upload, distribute or otherwise make available any Product, Provider Content or other material belonging to AngelImperatrix on TikTok or any other platform operated by ByteDance, except where expressly authorised by the Provider;
  • use a Service or Product to facilitate or promote conduct that would violate these Terms if carried out directly by the User;
  • use another User's Account, credentials or access permissions, or knowingly permit another person to use the User's Account in violation of these Terms;
  • create or use an Account for the purpose of circumventing a suspension, termination, restriction or other enforcement action imposed by the Provider;
  • use Public User Content or other User Content in a manner that violates the rights or reasonable expectations of the User who made such content available, or in violation of any restrictions communicated by the Provider;
  • submit or publish malicious, deliberately harmful or otherwise prohibited User Content through a Service;
  • submit or publish content that impersonates AngelImperatrix, the Provider, AngelImperatrix staff, an Administrator or another User;
  • use any Service or Product to distribute or promote content, material or activity that is intended to compromise the security, integrity or reputation of AngelImperatrix or its Services or Products; or
  • use any Service or Product to engage in any other conduct that materially interferes with the rights, safety, security or legitimate interests of the Provider, other Users or third parties.

A violation of the restriction concerning platforms operated by ByteDance constitutes a violation of these Terms. Where the relevant material is protected by intellectual property rights belonging to the Provider, the Provider may also take appropriate action to enforce those rights.
The User must not use any Service or Product in a manner intended to circumvent the purpose, limitations or safeguards of the relevant Service or Product, even where the specific conduct is not expressly listed above.
The Provider may take reasonable enforcement action in response to conduct that violates this section, including restricting or removing access to relevant features, removing or restricting User Content, suspending an Account or terminating an Account, subject to these Terms and Applicable Law.
Nothing in this section prohibits conduct that a User is expressly entitled to perform under Applicable Law, including any statutory right to access, modify, decompile, reverse engineer or otherwise analyse software where that right cannot lawfully be excluded or restricted.

X. User Content and Submissions

The User retains ownership of any intellectual property rights that the User holds in User Content submitted, uploaded or otherwise made available through a Service, except where otherwise provided by Applicable Law or a separate agreement.
By submitting, uploading or otherwise making User Content available through a Service, the User grants the Provider a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit and otherwise use that User Content to the extent reasonably necessary to provide, operate, maintain, secure and improve the relevant Service.
The licence granted under this section does not transfer ownership of the User Content to the Provider.
Where User Content is made publicly available through a Service, the User additionally grants the Provider the right to reproduce, display, communicate and otherwise make that Public User Content available to other Users and members of the public through the relevant Service and its associated functionality.
The User is responsible for ensuring that User Content submitted or made available through a Service does not violate these Terms, applicable Product-Specific Terms, Applicable Law or the rights of any third party.
The User must not submit, upload or otherwise make available User Content that the User does not have the right or permission to provide to the Provider for use in accordance with these Terms.
Submissions submitted to an Algorithmic Problem are private by default and are not made publicly available merely by being submitted to the relevant Service.
The Provider may store Submissions and associated evaluation results, scores and other relevant Progress Data within the User's Account in order to provide the relevant Service.
The Provider may retrieve and return a User's previous Submission to that User upon request or through functionality provided by the relevant Service, including where the User wishes to review, continue or modify a previously submitted Solution.
The User must not share, publish or otherwise provide a Submission to another person where doing so would circumvent the intended individual evaluation, learning or problem-solving nature of the relevant Service.
The Provider does not claim ownership of a User's Submission solely because the Submission has been submitted to or stored by a Service.
The Provider may remove, restrict access to or otherwise handle User Content where reasonably necessary to enforce these Terms, applicable Product-Specific Terms, Applicable Law or the rights and legitimate interests of the Provider or another person.
The Provider is not responsible for User Content created, submitted or made available by Users, except to the extent that responsibility arises under Applicable Law or from the Provider's own acts or omissions.
Nothing in this section grants the Provider any rights in User Content beyond those reasonably necessary for the operation of the relevant Services and the rights expressly granted under these Terms or applicable Product-Specific Terms.

XI. Community and Content Moderation

Certain Services may provide Users with features that allow them to publish, post, comment, communicate or otherwise make User Content available to other Users or to the public.
Public User Content must be suitable for a general audience aged 7 and above. The User must not publish or otherwise make available Public User Content that is sexually explicit, excessively violent, malicious, deliberately disturbing, or otherwise unsuitable for a general audience aged 7 and above.
The User must not publish or otherwise make available Public User Content that:

  • threatens, harasses, intimidates, abuses or deliberately targets another person;
  • contains malicious or deliberately harmful material;
  • impersonates the Provider, AngelImperatrix, any member of the AngelImperatrix staff, any Administrator or another User;
  • falsely represents an affiliation with, endorsement by or authority to act on behalf of the Provider or AngelImperatrix;
  • discloses another person's private or identifying information in a manner that may expose that person to harm, harassment or unwanted contact;
  • infringes or unlawfully uses the intellectual property, privacy, publicity or other rights of another person;
  • is intended to facilitate or encourage conduct prohibited by these Terms or Applicable Law; or
  • otherwise materially violates the standards applicable to the relevant Service or Product.

The Provider may provide moderation tools and administrative functionality for the purpose of maintaining the safety, integrity and appropriate operation of the Services.
An Administrator may hide Public User Content that appears to violate these Terms or the applicable rules of the relevant Service. Where reasonably appropriate, the User may be requested to modify the affected content so that it complies with the applicable requirements.
Where a User is requested to modify Public User Content, the User should make the required modifications within seven days of the request.
If the User does not modify the affected content within seven days of the request, the Provider may permanently remove that content from the relevant Service.
The Provider may remove Public User Content immediately where reasonably necessary, including where the content presents a security risk, contains malicious material, exposes another person to a significant risk of harm, or where immediate removal is required by Applicable Law.
Moderation actions may be taken in response to reports received from Users, observations by Administrators, automated detection systems or other reasonable means available to the Provider.
Users may report suspected violations of these Terms or inappropriate Public User Content by contacting the Provider through the support email address designated for such reports.
The Provider may restrict, suspend or terminate an Account where the User repeatedly or seriously violates the requirements applicable to Public User Content or otherwise engages in conduct that justifies such action under these Terms or Applicable Law.
The Provider does not guarantee that all User Content will be reviewed, detected or removed, or that moderation measures will identify every violation of these Terms.
The Provider may modify, suspend or discontinue moderation features and procedures where reasonably necessary or appropriate, subject to Applicable Law.
Nothing in this section limits any rights or obligations arising under Applicable Law.

XII. Intellectual Property

Unless otherwise stated, all intellectual property rights in and to the Website, Services, Products and Provider Content, including software, source code, object code, game assets, designs, graphics, text, audiovisual materials, documentation, trademarks, logos, names and other original materials created or provided by the Provider, belong to the Provider or are used by the Provider under an appropriate licence.
All rights in the Products and Provider Content are reserved by the Provider except for rights expressly granted to the User under these Terms, applicable Product-Specific Terms or Applicable Law.
Subject to these Terms and any applicable Product-Specific Terms, the Provider grants the User a limited, non-exclusive, non-transferable and revocable right to access and use the relevant Services and Products for their intended purposes.
The rights granted under these Terms do not include any right to sell, sublicense, distribute, reproduce, modify, adapt, publicly communicate, commercially exploit or create derivative works from any Product, Service or Provider Content, except where expressly authorised by the Provider or permitted by Applicable Law.
The User must not remove, alter, conceal or obscure any copyright notice, trade mark, attribution, licence notice or other proprietary notice contained in or associated with a Product, Service or Provider Content.
The AngelImperatrix name, logos, marks, designs and other identifiers associated with AngelImperatrix may not be used in a manner that falsely suggests endorsement, sponsorship, affiliation or authorisation by the Provider, except where expressly authorised by the Provider or permitted by Applicable Law.
Nothing in these Terms transfers any ownership of intellectual property from the Provider to the User or from the User to the Provider.
User Content and Submissions remain subject to the ownership and licensing provisions set out in Section X of these Terms.
Products or Services may contain components, libraries, tools, software or other materials provided by third parties and subject to separate licence terms. Where applicable, such third-party licence terms govern the relevant components in addition to these Terms.
The Provider reserves all rights not expressly granted to the User under these Terms, applicable Product-Specific Terms or Applicable Law.
Nothing in this section excludes or limits any intellectual property rights or other rights that cannot lawfully be excluded or limited under Applicable Law.

XIII. Third Party Services and Plstforms

The Services and Products may depend upon, interact with or be distributed through Third-Party Services and Platforms.
Third-Party Services and Platforms may include distribution platforms, marketplaces, game platforms, operating systems, hardware platforms, internet access and telecommunications services, hosting or infrastructure providers and other services or facilities operated by third parties.
The User's use of a Third-Party Service or Platform is subject to the terms, conditions, policies and requirements imposed by the relevant third party. Such terms and conditions apply independently of these Terms.
The Provider does not own, operate or control Third-Party Services and Platforms unless expressly stated otherwise.
The Provider is not responsible for the availability, security, functionality, performance, compatibility, policies or continued operation of a Third-Party Service or Platform, except to the extent that responsibility arises from the Provider's own acts or omissions or cannot lawfully be excluded under Applicable Law.
Where a Product is distributed through a Third-Party Service or Platform, the purchase, download, installation, licensing, payment, access or continued availability of that Product may be subject to the terms and requirements of the relevant third party.
The Provider does not guarantee that a Product or Service will remain available through any particular Third-Party Service or Platform.
The Provider may modify or discontinue support for a Third-Party Service or Platform where reasonably necessary, including where the relevant third party changes its services, requirements, policies, technical interfaces or terms.
The User must not use a Third-Party Service or Platform to circumvent these Terms, applicable Product-Specific Terms or technical, security or access restrictions imposed by the Provider.
Where a Third-Party Service or Platform provides functionality used to access or operate a Service or Product, the Provider may be unable to control or remedy problems arising solely from that third party's systems or services.
Nothing in these Terms creates a contractual relationship between the User and any third-party provider on behalf of that provider, nor does it modify any terms governing the User's relationship with such third party.
Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded or limited under Applicable Law.

XIV. Disclaimers

The Services and Products are provided on an "as is" and "as available" basis, to the fullest extent permitted by Applicable Law.
The Provider does not guarantee that any Service or Product will be uninterrupted, error-free, secure, accurate, complete, reliable or suitable for any particular purpose.
The Provider does not guarantee that any Service or Product will meet the User's individual expectations or requirements, or that any particular result will be achieved through its use.
The Provider does not guarantee that errors, defects, vulnerabilities or other issues affecting a Service or Product will be identified or corrected within any particular period of time.
Information, educational materials, Programming Tutorials, Algorithmic Problems, results, scores and other content made available through the Services are provided for their intended purposes and should not be treated as a guarantee of any particular educational, professional, competitive or other outcome.
The Provider does not guarantee that solutions submitted to an Algorithmic Problem will receive a particular result where the evaluation depends upon the correctness of the submitted Solution, the defined requirements of the relevant problem or other factors within the operation of the relevant Service.
The Provider does not guarantee that Progress Data, scores, achievements, Submissions or other User-associated data will remain available indefinitely, except where retention is required by Applicable Law or expressly stated otherwise.
The Provider does not guarantee that a Product or Service will remain compatible with any particular hardware, operating system, software, network, Third-Party Service or other technical environment.
The Provider does not guarantee the accuracy, legality, availability or suitability of User Content or content provided by third parties.
Nothing in these Terms excludes or limits any representation, warranty, condition or other right that cannot lawfully be excluded or limited under Applicable Law.

XV. Limitation of Liability

To the fullest extent permitted by Applicable Law, the Provider shall not be liable for any loss or damage arising out of or in connection with the User's access to or use of, or inability to access or use, any Service or Product.
To the fullest extent permitted by Applicable Law, the Provider shall not be liable for any indirect, incidental, consequential, special or exemplary loss or damage, including loss of profits, loss of revenue, loss of business opportunities, loss of anticipated savings, loss of goodwill or loss of data.
The Provider shall not be liable for loss or damage resulting from:

  • interruptions, errors, defects or unavailability affecting a Service or Product;
  • failures or interruptions affecting Third-Party Services or Platforms;
  • incompatibility between a Product or Service and the User's hardware, software, operating system, network or other technical environment;
  • unauthorised access to an Account resulting from the User's failure to maintain the security of the Account or its credentials;
  • User Content or other material created, submitted, published or otherwise made available by a User or third party;
  • the User's failure to comply with these Terms, applicable Product-Specific Terms or Applicable Law; or
  • any event or circumstance beyond the Provider's reasonable control.

The Provider shall not be liable for any loss of or inability to access Progress Data, Submissions, scores, achievements or other User-associated data, except to the extent that such liability cannot lawfully be excluded or limited.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under Applicable Law.
Where Applicable Law imposes mandatory rights, warranties, guarantees or remedies upon the Provider, nothing in these Terms is intended to exclude, restrict or otherwise limit those rights, warranties, guarantees or remedies.
To the extent that Applicable Law permits liability to be limited but does not permit it to be excluded entirely, the Provider's liability shall be limited to the maximum extent permitted by Applicable Law.

XVI. Suspension and Termination

The User may delete their Account at any time through the account functionality made available by the Provider, subject to any applicable procedures or requirements.
Upon deletion of an Account by the Account Holder, the Account will cease to be available for use and any Products or Services connected to that Account will be disconnected from it.
Public User Content associated with a deleted Account may remain available through the relevant Service. Where such content remains publicly available, the Display Name associated with that content will remain unchanged, while the username associated with the deleted Account will be replaced with the username "DeletedUser" or another designation used by the Provider for deleted Accounts.
Deletion of an Account by the Account Holder does not prevent the email address previously associated with that Account from subsequently being used to register another Account, subject to these Terms.
The Provider may suspend, restrict or terminate an Account where reasonably necessary to:

  • enforce these Terms or applicable Product-Specific Terms;
  • protect the security, integrity or proper operation of a Service, Product or the Website;
  • prevent or investigate misuse, abuse, fraud, security incidents or other harmful activity;
  • comply with Applicable Law or a lawful request from a competent authority; or
  • protect the rights, safety, security or legitimate interests of the Provider, Users or third parties.

The Provider may take immediate action where reasonably necessary to address serious or ongoing violations, security risks, malicious activity or other circumstances requiring prompt intervention.
Where reasonably appropriate, the Provider may instead notify the User of a violation and provide an opportunity to remedy the violation before restricting or terminating the Account.
The Provider may remove or restrict User Content in connection with a suspension or termination where reasonably necessary to enforce these Terms, applicable Product-Specific Terms or Applicable Law.
Where an Account is terminated by the Provider as a result of a violation of these Terms or applicable Product-Specific Terms, the Provider may prevent the email address associated with that Account from being used to register another Account.
A User whose Account has been terminated by the Provider must not create or use another Account for the purpose of circumventing the termination or any associated restriction.
Where a User whose Account has previously been terminated creates or uses another Account and subsequently violates these Terms or applicable Product-Specific Terms, the Provider may suspend or terminate that Account as well.
Termination of an Account does not affect any rights, obligations or provisions of these Terms that are intended by their nature to continue after termination.
Nothing in this section limits any rights or remedies that cannot lawfully be excluded or limited under Applicable Law.

XVII. Changes to the Services and Products

The Provider may modify, update, expand, restrict, suspend or discontinue any Service or Product from time to time.
Changes may include modifications to functionality, features, content, technical requirements, supported platforms, system architecture, availability, compatibility, access methods or other characteristics of a Service or Product.
The Provider may introduce new Services and Products or remove existing Services and Products where reasonably necessary or appropriate, subject to Applicable Law.
The Provider may make changes without prior notice where such changes are necessary to address security issues, technical vulnerabilities, legal requirements, abuse, operational risks or other circumstances requiring prompt action.
Where reasonably practicable, the Provider may provide advance notice of material changes that substantially affect a Service or Product.
A change to a Service or Product does not, by itself, constitute a modification of these Terms.
Where a change to a Service or Product materially affects the rights or obligations of Users, the Provider will take such steps as may be required by Applicable Law.
The Provider does not guarantee that any particular feature, Service or Product will remain available indefinitely.
Nothing in this section affects any rights or remedies that cannot lawfully be excluded or limited under Applicable Law.

XVIII. Changes to these Terms

The Provider may amend or update these Terms from time to time to reflect changes to the Services or Products, changes in Applicable Law, changes to the Provider's operations, security requirements or other legitimate operational reasons.
The most recent version of these Terms will be made available through the Website together with its effective date.
Where a change is material and materially affects the User's rights or obligations under these Terms, the Provider will provide reasonable notice of the change before it takes effect, unless a shorter period or immediate effect is permitted or required by Applicable Law.

Nothing in this section limits any rights or remedies that cannot lawfully be excluded or limited under Applicable Law.

XIX. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Romania.
Any dispute, claim or controversy arising out of or relating to these Terms, the Services or the Products shall be subject to the jurisdiction of the competent courts of Romania, unless Applicable Law requires otherwise.
Nothing in this section prevents a User who is a consumer from exercising any mandatory rights or bringing proceedings before any court or authority where such rights or jurisdiction cannot lawfully be excluded or restricted by agreement.
If any provision of these Terms is subject to mandatory laws or regulations of the jurisdiction in which the User resides, such mandatory provisions shall apply to the extent required by Applicable Law.
Nothing in these Terms is intended to deprive a User of any mandatory consumer protection, statutory right or remedy that cannot lawfully be excluded or restricted under Applicable Law.
